Your Harvest House Burleson is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code and is conducting the “2021 Benefit Raffle” to raise funds for charitable purposes. Below are the Rules & Regulations of the Raffle. By purchasing one or more Raffle tickets, the ticket purchaser agrees to be bound by these Rules & Regulations. Your Harvest House Burleson reserves the sole right to interpret these Rules & Regulations and its decisions under these Rules & Regulations shall be final.

 

Eligibility

           

     To purchase a ticket, you must be 18 years of age or older at the time of the purchase. Your Harvest House Burleson staff and members of its Board of Directors and the immediate family members of the staff and Board members are not eligible to win any Raffle prize. A ticket purchaser need not be present for the Raffle drawing on the evening of October 22, 2021.

     2021 Honda Civic Hatchback Sport.

 

Tickets

           

     Raffle tickets cost $100. There is no limit on the number of tickets purchased by one person. Only one name and one phone number are permitted on each ticket. Your Harvest House Burleson requires one method of payment for all tickets purchased by the same purchaser. Any ticket that contains more than one name will not be considered and will not go into the Raffle drawing.

            

     Raffle ticket purchases are non-refundable. 

           

     Any defaced tickets will not be considered and will not go into the Raffle drawing.

           

     Any purchased ticket(s) in which the method of payment failed (e.g., dishonored check or rejected credit card authorization) will not be considered and will not go into the Raffle drawing.

           

     Any purchased tickets must be purchased and Your Harvest House Burleson must be in possession of the ticket(s) by the drawing on October 22, 2021.

           

     Your Harvest House Burleson assumes no responsibility for lost, misdirected, or late ticket purchases or any other failure to receive the ticket(s) and proper payment by the drawing on October 22, 2021.

           

     If Your Harvest House Burleson receives any ticket(s) after October 21, 2021 @ 11:59 p.m., it will promptly return the tickets(s) purchase price to the purchaser.

 

Raffle Drawing

           

     The prize will be awarded in the evening of October 22, 2021.

           

     If the winner of a Prize is not present at the drawing, Your Harvest House Burleson shall make a reasonable number of attempts to call the contact number on the winning ticket. If those attempts are unsuccessful and the winner does not otherwise contact Your Harvest House Burleson by 5:00 p.m. on December 1, 2021, Your Harvest House Burleson will award that Prize to another winner at that time by drawing from the tickets not drawn on October 22, 2021.

           

      If for whatever reason, a Prize winner does not collect the Prize by December 1, 2021 at 5:00 p.m., Your Harvest House Burleson shall hold another Raffle for that Prize at that time. If that subsequent winner does not for whatever reason collect that Prize by December 15, 2021, the Prize will be forfeited.

 

Requirements to Receive Prize

           

     The Grand Prize winner of the 2021 Honda Civic Hatchback may only be collected upon the winner satisfying all of the following:

           

     (1)       he or she must deliver to Your Harvest House Burleson a sworn statement in which he or she warrants they meet the eligibility criteria;

           

     (2)       he or she must present valid proof of identity such as a drivers’ license that must match the name on the winning ticket;

           

     (3)       he or she must present the winning ticket;

     (4)       he or she must pick up the vehicle from Burleson Honda (632 N Burleson Blvd, Burleson, TX 76028)

           

     Your Harvest House Burleson agrees to pay the IRS the income tax on the Prize. The Prize winner of the 2021 Honda Civic Hatchback shall be solely responsible for applicable taxes and fees, including vehicle tax, title, license, and registration fees. The 2021 Honda Civic Hatchback shall be transferred to the winner “as is” and Your Harvest House Burleson does not make or provide any representation, guarantee, or warranty, expressed or implied, in connection with the vehicle. Your Harvest House Burleson further does not warrant the vehicle can be used for any particular purpose.

 

Odds of Winning

           

     The odds of winning a Prize will depend upon the number of tickets sold. If fewer tickets are sold, the chance of winning a Prize improves. Number of tickets sold is limited to 1,000.

General Terms and Conditions

           

     Your Harvest House Burleson makes no representation or warranties express or implied about any of the Prizes.

           

     Purchase of one or more tickets does not qualify a deductible charitable contribution under current IRS rules.

           

     A winner of a Prize should consult a tax advisor before collecting the Prize. Your Harvest House Burleson makes no representations about the taxability associated with any Prize.

           

     Purchasers of one or more tickets consent to Your Harvest House Burleson using their name and likeness in announcements and public statements concerning winners of one or more of the Prizes.

           

     By purchasing one or more tickets, each purchaser hereby holds harmless and releases Your Harvest House Burleson and its officers, directors, trustees, donors, employees, and agents from any and all liability, penalties, claims, damages, costs, and expenses (including but not limited to attorneys’ fees) arising from or related to such purchase or the Raffle.

           

     A purchaser of one or more tickets shall solely have as a remedy for Your Harvest House Burleon’s breach of any of these Rules & Regulations the return of the purchaser’s cost to purchase the tickets(s). Under no circumstances shall Your Harvest House Burleson and its officers, directors, trustees, donors, employees, and agents be liable to any ticket purchaser for any consequential, special, or punitive damages.

           

     Any dispute arising between a ticket purchaser and Your Harvest House Burleson arising out of or relating to the Raffle shall solely be heard and resolved by binding arbitration in Johnson County, Texas before a single arbitrator and administered under the expedited procedures under the Commercial Arbitration Rules of the American Arbitration Association.
